ORDERS are booked with the understanding that same shall be void should injury befall the stock from flood, drought, fire, frost, hail, errors in count, or other causes beyond our control.

SIZE SUBSTITUTIONS are sometimes necessary. When a change of more than one size up or down the customer is always notified for approval prior to shipping. Any specific instructions regarding customer orders, substitutions, shipping, etc. should be sent to us in writing at time of placing order.

TERMS are net 30 days. Thereafter a 2% bookkeeping charge per month. Cash in advance is required unless credit rating has been established.

PACKING CHARGES for boxes or bales are additional at our cost. Bulk orders are loaded free.

GRADE STANDARDS are those adopted by the American Association of Nurserymen.

PRICES herein are F.O.B. Vincennes, Indiana and are wholesale to the nursery trade only, subject to market change.

SHIPMENTS travel at the risk and cost of the purchaser. Our responsibility ceases on delivery to carrier.

CLAIMS for any cause will receive consideration only when made within 10 days after arrival of goods. In no case will we entertain claims made after goods have once been accepted. If any nursery stock proves untrue to name under which it is sold, we hold ourselves in readiness, on proper proof, to replace all such nursery stock, etc. that may prove otherwise, or refund the amount paid, or extend credit to the next order, but we shall in no case be liable for any sum greater than the amount originally received for said nursery stock.

GUARANTEE We give no warrantee, expressed or implied, as to life, description, quality, productiveness, or any other matter of any nursery stock or plants that we sell. It is mutually agreed that our total liability for any error, should stock prove untrue to name as labeled, shall be limited upon satisfactory proof, to our replacing free or refunding the purchase price thereof.
